\nthird-party transportation service providers (\u201cDrivers\u201d), and to facilitate transactions among Riders and Drivers who use the OBR Platform (together referred to as \u201cUsers\u201d). The OBR Platform includes the Application and any other feature
\ncontent, websites or applications o\u00daered from time to time by OBR in connection with the Application. THE OBR PLATFORM DOES NOT INCLUDE THE PROVISION OF TRANSPORTATION SERVICES. OBR IS A TECHNOLOGY PROVIDER, NOT A
\nTRANSPORTATION CARRIER, AND OBR HAS NO RESPONSIBILITY OR LIABILITY FOR ANY TRANSPORTATION SERVICES PROVIDED BY THIRD PARTIES.

If you are traveling in a vehicle ordered via the Service, the driver\u2019s mobile phone will record your GPS coordinates. Most GPS enabled mobile devices can de\u00aene one\u2019s location within Iraq area. We collect this information in order to calculate your fare and do not use it fo

\nWe also collect users\u2019 device<\/strong> types and unique identi\u00aeers. We use this information for the sole purpose of providing you with the most up to date application and features. You may also choose to upload a photo while using the site or
\napplication, if you wish to do so, this information may be viewable by the drivers who are picking you up so that they are able to verify your identity. You may remove such photos or update them at any time by logging into your account. If
\nyou use our services through your mobile device, we will track your geo-location information so that you are able to view the drivers in your area, set your pick up location, and so that drivers are able to \u00aend your pick up location We will no
\nshare this information for any other purpose and will only use this information for the sole purpose of ful\u00aelling your request. You may at any time no longer allow our application to track your geo-location information by turning o\u00da the
\ngeo-tracking function on your mobile device.

\nArbitration Rules and Governing Law<\/strong>
\nThe arbitration will be administered by the American Arbitration Association (\u201cAAA\u201d) in accordance with the Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes (the \u201cAAA Rules\u201d) then in e\u00daect,
\nexcept as modi\u00aeed by this \u201cDispute Resolution\u201d section. (The AAA Rules are available at www.adr.org\/arb_med or by calling the AAA at 1-800-778-7879.) The Federal Arbitration Act will govern the interpretation and enforcement of this

\nArbitration Process<\/strong>
\nA party who desires to initiate arbitration must provide the other party with a written Demand for Arbitration as speci\u00aeed in the AAA Rules. The arbitrator will be either a retired judge or an attorney licensed to practice law in the
\nCommonwealth of Virginia and will be selected by the parties from the AAA\u2019s roster of consumer dispute arbitrators. If the parties are unable to agree upon an arbitrator within seven (7) days of delivery of the Demand for Arbitration, the
\nthe AAA will appoint the arbitrator in accordance with the AAA Rules.
\nArbitration Location and Procedure<\/strong>
\nUnless you and Company otherwise agree, the arbitration will be conducted in the county where you reside. If your claim does not exceed $\u2026, then the arbitration will be conducted solely on the basis of documents you and Company subm
\nto the arbitrator, unless you request a hearing or the arbitrator determines that a hearing is necessary. If your claim exceeds $\u2026, your right to a hearing will be determined by the AAA Rules. Subject to the AAA Rules, the arbitrator will have
\nthe discretion to direct a reasonable exchange of information by the parties, consistent with the expedited nature of the arbitration.
\nArbitrator\u2019s Decision<\/strong>
\nThe arbitrator will render an award within the time frame speci\u00aeed in the AAA Rules. The arbitrator\u2019s decision will include the essential \u00aendings and conclusions upon which the arbitrator based the award. Judgment on the arbitration awa
\nmay be entered in any court having jurisdiction thereof. The arbitrator\u2019s award damages must be consistent with the terms of the \u201cLimitation of Liability\u201d section above as to the types and the amounts of damages for which a party may b
\nheld liable. The arbitrator may award declaratory or injunctive relief only in favor of the claimant and only to the extent necessary to provide relief warranted by the claimant\u2019s individual claim. If you prevail in arbitration you will be entitle
\nto an award of attorneys\u2019 fees and expenses, but only to the extent provided under applicable law. Company will not seek, and hereby waives all rights it may have under applicable law to recover, attorneys\u2019 fees and expenses if it prevails in
\narbitration.
\nFees<\/strong>
\nYour responsibility to pay any AAA \u00aeling, administrative and arbitrator fees will be solely as set forth in the AAA Rules. However, if your claim for damages does not exceed $\u2026, and if you prevail in the arbitration by receiving damages for th
\nclaimed amount set forth in your complaint, Company will pay all such fees.
\nChanges<\/strong>
\nNotwithstanding the provisions of the modi\u00aecation-related provisions above, if Company changes this \u201cDispute Resolution\u201d section after the date you \u00aerst accepted this Agreement (or accepted any subsequent changes to this Agreement)
\nyou may reject any such change by sending us written notice within 30 days of the date such change became e\u00daective, as indicated in the \u201cLast Updated Date\u201d above or in the date of Company\u2019s email to you notifying you of such change.
\nBy rejecting any change, you are agreeing that you will arbitrate any Dispute between you and Company in accordance with the provisions of this \u201cDispute Resolution\u201d section as of the date you \u00aerst accepted this Agreement (or accepted
