• Obr Taxi Platform: Refers to the digital platform provided by Obr Taxi for the provision of Transportation Services.
• Obr Taxi Services: Refers to the services provided by Obr Taxi, including the facilitation of transportation requests, payment processing, and driver support.
• Affiliates: Refers to any entity controlled by, controlling, or under common control with Obr Taxi.
You agree not to engage in any activities that may harm, interfere with, or disrupt the Obr Taxi Platform or Obr Taxi Services. This includes but is not limited to hacking, tampering, or attempting to gain unauthorized access to the platform. Any violation of these terms may result in immediate termination of your access to the Obr Taxi Platform.
The Obr Taxi Platform and all related intellectual property rights are owned by Obr Taxi or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Obr Taxi Platform solely for the purpose of providing Transportation Services.
• Wallet Deposit: Obr Taxi operates on a prepaid system where drivers are required to deposit funds into their Obr Wallet prior to providing transportation services. Funds in the Obr Wallet will be used to cover trip payments, service fees, and any other applicable charges. Drivers must ensure that their Obr Wallet has a sufficient balance to cover these expenses. Failure to maintain an adequate balance may result in the inability to accept trip requests.
• Drivers may also recharge their wallets using external payment methods supported by Obr Taxi, but Obr Taxi shall not be liable for any issues arising from the use of third-party payment services.
• Obr Taxi reserves the right to deduct any outstanding amounts owed by drivers from their digital payments or other monies payable.
• Users may choose cash payment or Obr Taxi Wallet Payment for trips.
• Obr Taxi Wallet Payments do not constitute tips and are treated as a debt owed by drivers to Obr Taxi.
• Drivers are responsible for managing cash payments and any Obr Taxi Wallet Payments received from Users.
. Recording and Collection of Underpayments
• Underpayments by Users will be recorded in the Obr Taxi App.
• Obr Taxi reserves the right to deactivate underpayments as a feature.
• Drivers are not obligated to compel or demand payment for negative User balances.
• Obr Taxi charges a service fee for access to the Obr Taxi Platform, calculated as a percentage of the Fare.
• Service Fee calculation may include taxes, and Obr Taxi reserves the right to adjust the fee at any time.
• Users may incur cancellation fees for cancelled Transportation Services, which are deemed as Fares for drivers.
• electronic receipts are automatically sent to Users after each Trip, including details of the Fare and driver information.
• Drivers must report any discrepancies in receipts to Obr Taxi within two business days.
• Drivers are responsible for fulfilling all tax obligations related to the provision of Transportation Services.
• Obr Taxi may collect and remit taxes on behalf of drivers where required by law.
• Obr Taxi provides the services “AS IS” and disclaims all warranties.
• Obr Taxi shall not be liable for any indirect, incidental, or consequential damages arising from the use of the Obr Taxi Platform or Services.
• Drivers agree to indemnify and hold Obr Taxi and its Affiliates harmless from any claims, losses, or damages arising from their use of the Obr Taxi Platform.
• Disputes shall be settled by binding arbitration in accordance with the laws of the jurisdiction in which the relevant Obr Taxi entity is incorporated.
• Mediation may precede arbitration, and the language of mediation/arbitration shall be English unless otherwise agreed.
• Obr Taxi may share driver information with third parties as outlined in the Agreement.
• Driver’s personal data may be retained for legal, regulatory, and safety purposes after the termination of this Agreement.
• This Agreement is governed by the laws of the jurisdiction in which the relevant Obr Taxi entity is incorporated.
• Obr Taxi may engage Affiliates for service provision, and specific provisions apply to drivers associated with Fleet Companies.
• Obr Taxi reserves the right to modify, amend, or update any of the terms and conditions outlined in this agreement, including payment methods, fee structures, and policies related to driver earnings and obligations. Any changes will be communicated to drivers through the Obr Taxi Platform or via email. Continued use of the Obr Taxi Platform after such modifications constitutes acceptance of the updated terms and conditions.

In addition, tracking information – which will be used in the background – is collected as you navigate through our website (the “Website”) or use the Service, including, but not limited to geographic areas. If you are traveling in a vehicle ordered via the Service, the driver’s mobile phone will record your GPS coordinates. Most GPS enabled mobile devices can define one’s location within Iraq area. We collect this information in order to calculate your fare and do not use it for any other purpose.
We also collect users’ device types and unique identifiers. We use this information for the sole purpose of providing you with the most up to date application and features. You may also choose to upload a photo while using the site or application, if you wish to do so, this information may be viewable by the drivers who are picking you up so that they are able to verify your identity. You may remove such photos or update them at any time by logging into your account. If you use our services through your mobile device, we will track your geo-location information so that you are able to view the drivers in your area, set your pick up location, and so that drivers are able to find your pick up location We will not share this information for any other purpose and will only use this information for the sole purpose of fulfilling your request. You may at any time no longer allow our application to track your geo-location information by turning off the geo-tracking function on your mobile device.

17. Access to your personal information:
If your personal information changes, or if you no longer desire our service, you may correct, delete, or amend it by making the change on our member information page or by emailing us at support@obr.taxi. We will respond to your access request within 30 days.
We will retain your information (including geo-location) for as long as your account is active or as needed to provide you services. If you wish to delete your account or request that we no longer use your information to provide you services, you can do by selecting “Delete Account” on your profile tab. Alternatively, you can request to delete your account at support@obr.taxi. When your account is deleted, all the personal information and other data linked to it is also deleted.We will only retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
